WHAT IS A PROCESS AGENT?
A process agent is someone on record to accept service of legal documents on behalf of your company.  The FMCSA requires that you have a process agent in every state that you travel through or do business in.  The BOC-3 form for designation of agents must be filed with the Federal Motor Carrier Safety Administration to complete your authority.  We submit all BOC-3 forms to the FMCSA via "Electronic Filing", and post the information to the FMCSA files daily.

GOING INTO THE TRUCKING BUSINESS
The first step in obtaining a new motor carrier authority is to complete the OP-1 application with the Federal Motor Carrier Safety Administration (FMCSA).  Once the OP-1 application is submitted to the FMCSA you are assigned a "Docket Number", and after approval your application is published in the FMCSA Register.

GET A USDOT NUMBER

If you have not already done so, a USDOT Number may also be required.  The MCS-150 (Motor Carrier Identification Report) and the MCS-150A (Safety Certification Application) forms must be completed (no fee is required).  The forms can be found on the FMCSA Safety and Fitness Electronic Records (SAFER) System web site (click on “FMCSA Registration & Updates”), and can be downloaded or submitted on line.  Or you can contact the USDOT at 800-832-5660 for more information.

DESIGNATION OF PROCESS AGENTS
The FMCSA requires the filing of a BOC-3 form for designation of process agents for all interstate authorities.  This means having someone on record with the FMCSA to accept service of legal documents on behalf of the trucking company.  The FMCSA requires that you have a process agent in every state that you travel through or do business in.  And the BOC-3 form for designation of process agents must be filed with the FMCSA to complete or maintain the motor carrier authority.

PROOF OF INSURANCE
Depending on the type of authority applied for, the FMCSA will have specific insurance requirements that MUST be filed before the FMCSA will complete the authority application process.  The FMCSA will notify you directly of these requirements.  The FMCSA needs proof of insurance coverage in the form of their “BMC-91” or “BMC-91X” forms for liability, and a “BMC-34” for cargo.  Broker authority requires either the “BMC-84” or “BMC-85” form.  The insurance company is responsible for submitting these filings to the FMCSA and will need the "Docket Number" assigned by the FMCSA to make the proper filings.  Insurance providers should contact the FMCSA directly at 1-202-385-2423 if they have any questions regarding the insurance filings.
